Plaintiff was a first lieutenant of Infantry in the National Army during World War I. He was wounded, awarded the Distinguished Service Cross and the Croix de Guerre for gallantry in action, and was honorably discharged on October 14, 1919. On December 13, 1928, he was placed on the Emergency Officers' Retired List, and from that date until June 29, 1948 he drew retired pay equal to 75 per centum of his pay as a first lieutenant.
