In an indictment returned by the grand jury of Los Angeles County, defendant was accused of a violation of section 11502 of the Health and Safety Code in that on or about February 21, 1956, he agreed to furnish and sell a preparation of heroin to one John Doe, and did thereafter furnish and sell to said person another substance in lieu of heroin. The indictment was amended to allege two prior felony convictions, to wit: grand theft in the Superior Court...
