This appeal involves a narrow question of Ohio law. Appellant was injured in a collision with the appellee's vehicle on October 23, 1954. On October 5, 1956, he filed a petition in the Common Pleas Court of Lucas County, Ohio, asking a judgment of $40,000 for personal injuries and property damage.
