In 1949 Sam Neider brought an action against Virgil Dardi and the General Refrigerator Corporation for an accounting. The complaint was founded on a written instrument of joint venture executed by Neider and Dardi. The trial court, after a full hearing, granted an interlocutory decree to Neider, which, among other things, contained an order appointing a receiver to manage the property of the venture until a final accounting could be had.
