HOLDEN, Justice.

This action at law is founded in contract. It was instituted by the plaintiff in the Montpelier Municipal Court. The defendant challenged the sufficiency of the complaint by demurrer. The demurrer was sustained and the plaintiff's exception to this ruling was passed to this court before final judgment under the provisions of V.S. 1947, § 2124.
