This is an action for workmen's compensation filed by the plaintiff in forma pauperis in the District Court alleging that:

On or about April 29, 1955 while working for Teche Oil Company which was insured by defendant for workmen's compensation, plaintiff was unloading a truck of 100 pound sacks of fertilizer. While unloading this truck he sustained an injury to his back, the injury having occurred during the course and scope of his employment...
