This appeal is taken from a judgment dismissing a petition for a writ of habeas corpus. The prisoner was indicted at the November Term, 1952 for assault with intent to rob. He was tried before a jury on June 23, 1953, found guilty and, on June 25, 1953, sentenced to a term of nine years and six months.1
