KELLEY, P.J.
Appellant filed a claim for services "performed, furnished and rendered" to her father, the decedent, continuously from April 15, 1945 to March 27, 1953, the date of his death. At the close of appellant's evidence, the court sustained the appellee's "motion for judgment" and entered judgment for appellee. Such action by the court is here assigned as error as is also the overruling by the court of appellant's motion for a new trial.
