SUTTON, Justice.

This is an original proceeding in the nature of prohibition.

The Rocky Mountain Bank Note Company, a Colorado corporation, brought suit against Betty Keator and Chester V. Stull, alleging "That said defendants, and each of them, are indebted to plaintiff company, in an unknown amount in excess of Forty-Four Hundred ($4,400.00) Dollars representing moneys and funds fraudulently procured from plaintiff."
