Defendant in error, plaintiff below, initiated this action to recover damages resulting from the destruction of certain growing crops on premises leased by him. In substance, his petition alleged that he owned an agricultural lease on the described property for the year 1953; that he had a wheat crop on part of the land, two acres of which he had to delay harvesting because it was situated on low ground which was too wet to move over at the regular harvest...
