The offense is the possession of heroin; the punishment, 10 years.

Officer Tucker of the Narcotic Division of the Houston Police Department testified, in the absence of the jury on the issue of the validity of the search warrant, that on the day in question, while acting undercover, he purchased two "caps" of heroin from the appellant; that he then made an affidavit for a search warrant to search the appellant's home.
