BURNETT, Justice.

Gibbs was indicted, tried and convicted for the murder of Mrs. Vassey Bratcher and as a penalty was sentenced to electrocution.

This homicide occurred in the early part of March, 1955. The deceased lived with her husband in Warren County about 8 miles from McMinnville. Living with this couple was their daughter about 12 or 13 years of age and the 2 year old granddaughter. The plaintiff in error is a young man who lived a very short distance...
