This is an appeal by defendant from an order and decree for plaintiff permanently enjoining defendant from interfering with waters in Bousquet Ditch. The controversy arises over the plaintiff alleging that the defendant, on or about July 15, 1951, diverted water from Bisson Creek into Bousquet Ditch, and then wasted said water and deprived the owners thereof of such water.
