During the summer of 1954, one, Phil Daniel, had operated a fruit stand on the highway in or near Idaho Falls, and during that season had become indebted to the defendant (appellant) for rental. In September, 1955, Daniel was employed by the plaintiff (respondent) and was operating a truck owned by the plaintiff to which was attached a refrigerated semi-trailer.
