Plaintiff brought this suit under the provisions of the Federal Tort Claims Act, Title 28 U.S.C.A. §§ 1346(b) and 2674. He seeks to recover damages for alleged injuries while incarcerated as a federal prisoner.

Plaintiff was convicted of a Dyer Act, 18 U.S.C.A. §§ 2311-2313 violation and was sentenced for a term of from four months to one year and one day. He was first incarcerated in the District of Columbia jail, and...
