Appellant, a private detective, was employed by Sammy Fain to obtain evidence for use in an action for divorce which Fain had brought in a New York State court against his wife Sally. The spouses were separated and the wife was living with her son in an apartment in a hotel in New York City, in which there was installed a private phone, listed in her name.
