This is a hearing originally held December 11, 1956 for criminal contempt for failure to obey two orders of the court dated January 10 and July 12, 1956. On December 27, after my findings against defendant had been announced, counsel's argument on sentence suggested that he had failed to introduce available evidence regarding the Fifth Amendment, possibly due to neglect, and I reopened the case.
