DUFFY, Chief Judge.

This suit was commenced by the Railroad Company to collect damages resulting from a collision between one of its trains and an automobile owned and driven by defendant. The jury returned a verdict favorable to the defendant, and the District Court entered judgment dismissing the complaint and rendering judgment for costs against plaintiff.
