Fugitt and wife Irma instituted this proceeding for title and possession of their leasehold estates in and to some 30 acres of land, and to enjoin appellant landlord from enforcing a judgment of restitution rendered by County Court at Law No. 2, Dallas County, involving the same property and same parties with exception of Mrs. Fugitt. Slay answered with motion to dismiss, plea of res adjudicata, and that said County Court judgment was not thus...
