From judgment non obstante veredicto for defendant the plaintiff appeals. His suit was for damages resulting from injuries sustained in an accidental fall while a "business invitee" on defendant's premises.

Viewing the testimony in the light most favorable to plaintiff, pertinent facts are: Plaintiff entered upon defendant's race-track property and went to a concrete paved area beneath the grandstand; he stood there for 10 or 20 minutes...
