This is a case in which the People filed an information charging the defendant with having committed a lewd and lascivious act in that he exposed himself in public. On his plea of not guilty, he was tried before the court without a jury on this charge, and though all of the evidence was heard, the court never ruled on the guilt or innocence of defendant.
