CLEARY, Justice.

This is an action of tort for the alleged negligence of the defendant in operating his automobile, which resulted in personal injuries to the plaintiff. Trial was by jury with a verdict and judgment for the plaintiff. At the close of the plaintiff's case, and at the close of all the evidence, the defendant moved for a directed verdict in his favor.
