This is an action to recover damages for the alleged breach of a contract between defendant and plaintiff's assignor, under the terms of which the Office of Foreign Liquidation Commissioner, Department of State (hereinafter referred to as OFLC) agreed to sell and plaintiff's assignor agreed to purchase 50 surplus Government aircraft.
