This case was brought by J. M. Sparks against the State of Texas and the State Highway Department for damages alleged to have been caused to plaintiff's property by reason of inadequate construction and improper maintenance of Farm to Market Road 880. The road runs along the west boundary line of plaintiff's farm. Plaintiff's petition contained allegations that improper and inadequate construction and maintenance of said road by the State Highway...
