Mrs. Sue Ella Goodrich brought this suit against Rosa Morgan to recover damages for the alleged wrongful killing of Norman W. Goodrich, husband of plaintiff, by Rosa Morgan.

For cause of action plaintiff alleged:

"That on or about midnight on June 8th, 1953, the deceased, Norman W. Goodrich, was on his way home from work, walking along the northern sidewalk of Mulberry Street...
