MOISE, Justice.

Dr. Joseph A. LaNasa, a physician and surgeon in the City of New Orleans, Louisiana, for over thirty years, was charged by Bill of Information with having failed "to properly fill out a certificate of the death of one Alice Busch, deceased, by failing to write with black ink on said certificate, as required by [LSA-]R.S. 40:154."

The defendant was tried, convicted and sentenced, under LSA-R.S. 40:267, to pay a fine of $400 and in default thereof...
