The principal contention raised in behalf of the appellant Simpson's on this appeal is that the evidence does not support the verdict and judgment.

It is not unusual in cases of this kind for the evidence to be in sharp conflict on certain points, and such proved to be the case in the course of the instant trial. However, in passing upon the issue of whether the evidence supports the verdict it is only necessary to consider such testimony and exhibits...
