Appellee instituted this suit in the District Court of Harris County seeking to establish a trust in her favor equal to a fifty per cent interest in land, the legal title to which is vested in appellant. She based her suit upon allegations, the substance of which are as follows: Appellant had been, at a time prior to the occurrence of the events giving rise to this litigation, married to the son of appellee.
