The parties hereto sought a construction and declaratory judgment of the last will and testament of Robert E. Trout and the trust thereby created. The provision of the will which is the subject of this action is as follows:

"All the balance and remainder of my property of every kind and character, both real and personal which I own at the time of my death, I will, devise and bequeath to Arthur L. Hart, as Trustee and in trust on the following terms...
