Mr. Chief Justice Blume delivered the opinion of the court.

The defendant Clay Riggle was charged with the crime of first degree murder. He pleaded not guilty, and later further pleaded not guilty by reason of insanity. A trial was had, and the jury convicted the defendant of first degree murder without adding the phrase "without capital punishment" as permitted by the provisions of § 9-201, Wyoming Compiled...
