Appellees Katy Weidner Crowther and Agnes Weidner Bose joined by their husbands brought this suit against appellant Homuth Weidner to enforce the terms of the joint will of Hugo Weidner and his wife Sophie Weidner which will they alleged was contractual and was made pursuant to an agreement. They prayed that:

"* * * the Mutual Last Will and Testament of Hugo Weidner and Sophie Weidner, be established...
