The appellant, Herbert Eads, was convicted of the offense of involuntary manslaughter for the killing of Bennie Luttrell at Rough Ridge in Casey County on February 12, 1956, and sentenced to one year in jail and fined $500. The unfortunate and unintended killing occurred as the result of an argument during "a little old sorry crap game" in which the two men were participants along with several other sportsmen.
