At about 5 A.M. on the 13th of March, 1954 the defendant, with two young ladies as his guests, was traveling east on highway 190 just west of the town of Elton when he collided with an automobile being driven in a westerly direction on said highway by the plaintiff Rizley, with whom the plaintiffs Mershon and Meade were riding as guest passengers. Also a passenger was First Class Sgt. Kirk, who filed no suit.
