BURNETT, Justice.

Sturgis was indicted and convicted for the violation of the Age of Consent statute, Williams' Code, Section 10786, T.C.A. 39-3706. The punishment as fixed by the jury was a penitentiary sentence of 10 years. From this judgment the plaintiff in error has seasonably appealed, briefs have been filed and arguments heard and we now have the matter for disposition.
