The appellant, W.O. Phelan, appeals from a decree of the Chancery Court of Gibson County allowing his brother, the defendant and appellee, R.E. Phelan, credit by way of set-off against a $4,000 note executed by the defendant, R.E. Phelan, to W.O. Phelan on April 10, 1954. The two items of set-off allowed by the Chancellor totaled $2976.88.
