Plaintiffs filed a complaint in assumpsit to recover the installments paid by plaintiffs under a written agreement of purchase of real estate from defendant, to which defendant filed an answer and counterclaim. The matter is now before the court on motion of plaintiffs for judgment on the pleadings, consisting of the complaint, answer, counterclaim and reply thereto.
