PAOLINO, Justice.
This action of trespass on the case was brought under general laws 1938, chapter 477, § 1, commonly known as the death by wrongful act statute. It is before this court on the plaintiff's bill of exceptions to the order of the superior court granting defendant Anna Krikorian's motion to strike the fourth amended declaration and entering judgment for that defendant on the demurrer to the third amended declaration as previously sustained.
