The above entitled action was commenced by the service of a summons on the defendant on February 2, 1955 in the county of Albany, where the defendant resided. For this reason the defendant, after judgment was taken, now appears specially and asks that the judgment be vacated.

It appears, however, that the defendant was employed at the General Electric plant in Schenectady County...
