Defendant Larson made a shipment of eggs from Iowa to plaintiff in New York, with sight draft attached to the bill of lading. Plaintiff paid the sight draft. Later it brought this action at law to recover the amount paid for the eggs, alleging they had been destroyed en route and also that the carrier had paid defendant therefor.
