Defendant has appealed from a conviction and sentence for murder in the first degree, where the death penalty was imposed.

The offense was alleged to have been committed in the City of St. Louis on December 20, 1954. An indictment charging appellant and one Sterling Quinn with murder in the first degree of one Abe Levitt was returned and filed on February 4, 1955.
