At the March Term, 1954, of the Criminal Court of Harrison County, the defendant, John Cirullo, was indicted for a misdemeanor by a grand jury of that county then attending that term of the court. The indictment charged that the defendant, in November 1953, "and within one year prior to the finding of this indictment, in the said County of Harrison, did unlawfully, without a state license and without authorization...
