Defendant and six others were indicted jointly on November 23, 1954, for the murder of Walter Lee Donnell, who was slain during the riot at the Missouri Penitentiary on the evening of September 22, 1954. All of the defendants were inmates of the penitentiary, as was Donnell. On December 6, 1954, counsel was appointed for this defendant.
