Appellant John Houtman was charged by indictment with the crime of forgery, it being alleged in the indictment:

"That on the 7th day of January A.D. 1954 at the County of Sacramento, in the State of California, the said Defendant. JOHN HOUTMAN, did then and there willfully and unlawfully and feloniously with intent to defraud WILLIAM A. SUTTON COMPANY and AMERICAN TRUST COMPANY, San Francisco, California, make, draw and utter a forged instrument...
