This case is before the court on defendant's motion to dismiss plaintiff's petition on the ground that it does not state a cause of action.

The material allegations of the petition are as follows: On March 17, 1952, the Ordnance Tank Automotive Center, Ordnance Corps, United States Army (hereinafter referred to as OTAC) advertised for bids on 5,500 low-voltage circuit testers.
