This is a proceeding under article 78 of the Civil Practice Act to compel the above-named respondent to enter a judgment in favor of the petitioner Nicholas Castanos in the amount of $32,500 plus costs. Hereinafter, Castanos will be referred to as "plaintiff", the position which he occupied in the action which is the basis of this application.
