DUFFY, Chief Judge.

Plaintiff seeks an injunction restraining defendant from using the term "Riverbank" in its business. Jurisdiction is based upon diversity of citizenship. Plaintiff moved for a temporary injunction. Defendant moved to dismiss the action because of a lack of proper venue. The District Court denied the motion to dismiss but granted the motion for a temporary injunction.
