This is a tort action instituted by Clifton Newman against the Fidelity Mutual Insurance Company for damages resulting from an accident which occurred in the City of Lake Charles on December 29, 1953.

The petition alleges that on the day of the accident the petitioner, while a guest in a 1952 Pontiac automobile owned by one Dalton J. Breaux, suffered a fractured arm and other injuries when the car door on the right front side suddenly opened...
