MILLER, Justice.

On the afternoon of November 8, 1953, Joan Listen Ward, two years and four months old child of E. W. Ward, was struck and killed by an automobile as it was being backed by Cathryn A. Lewis along a private driveway extending from her garage to the street in front of her residence.
