This is an article 78 proceeding by the petitioner to require the Civil Service Commission to certify the petitioner to the police commissioner, and for the police commissioner to appoint him to the position which he seeks. Respondents cross move to dismiss the proceeding on the ground that it was not commenced within the time specified under section 1286 of the Civil Practice Act.
