This is an action against defendantappellant, Harry A. Berning, to enforce a mechanics' lien originally instituted by one Lester Wilson. After trial and judgment in his favor, Wilson died and James F. Wilson, Administrator of his estate, respondent, was substituted as plaintiff. We shall refer to Lester Wilson as plaintiff.
